Copyright Clearance Center Supports Infringement Suits Brought by 10 Publishers Against Massachusetts Copy Shops

DANVERS, Mass., Nov. 15, 2005–Copyright Clearance Center (CCC), the world’s premier provider of copyright licensing solutions, announced its support for two major lawsuits brought today by 10 leading publishers against copy shops serving colleges and universities in Boston and western Massachusetts. The suits are two of the largest, coordinated actions taken by publishers against alleged copyright violations.

DANVERS, Mass. - March 30, 2004 - The University of Chicago Press, Princeton University Press, Elsevier Inc., Pearson Education Inc., John Wiley & Sons Inc. and SAGE Publications today announced a settlement in a recent copyright infringement lawsuit against BISI Inc., Netpaks, Abel’s Copies and Speedway Copying of Austin, Texas. The lawsuit, announced in February 2004, charged that these college coursepack providers routinely duplicated and distributed copyrighted materials, including electronic content, without obtaining permission directly from the plaintiffs or through their licensing agent Copyright Clearance Center. The defendants have agreed to pay undisclosed damages to the publishers and adopt compliant business practices going forward.

Do you use eReserves?

The UCSD Guardian student newspaper is reporting that the Association for American Publishers believes that materials in the university’s electronic reserves may be in violation of a federal copyright law. The eReserves is a free service for students and faculty that provides online access to the material professors use in course readers. Allan Adler, the vice president for legal and government affairs for the AAP, said professors made large numbers of postings in violation of authoras’ and publishers’ copyrights. Professor Frederick of the Sloan School of Management wonders if Sony’s CEO has the right view on product development. “Our plan is to lead the public with new products rather than ask them what kind of products they want. The public does not know what is possible, but we do. So instead of doing a lot of market research, we try to create a market for a product by educating [the public about what the product can do for them]. ” (Akio Morita, CEO of Sony). - What is your opinion?

Major Publishers Sue California College Bookstore Chain for Copyright Infringement

DANVERS, Mass. (January 26, 2004) - Five major publishers have filed a copyright infringement suit against KB Books, a college bookstore chain in San Diego, California. Harvard Business School Publishing, The New York Times, Elsevier Inc., Pearson Education and John Wiley & Sons Inc. allege that KB Books has routinely produced and sold coursepacks to college students in the San Diego area without obtaining permission to use the content from the publisher or Copyright Clearance Center, the publishers’ licensing agent. The publishers’ complaint was filed recently in the U.S. District Court for the Southern District of California.

Illegal Copying Alleged in Lawsuit

Harvard Business School Publishing, The New York Times and three other publishers have sued a small San Diego bookseller over allegations it violated copyrights on materials it copied for college students. KB Books, which has stores near San Diego State University, San Diego City College and Mesa College, engaged in 131 incidents of copyright infringement, according to a suit filed in federal court in San Diego.

Escalating Copyright Infringement Lawsuits

Recent developments in intellectual property litigation demonstrate the escalating seriousness of copyright infringement. In the past year, rights holders in various industries took legal action against businesses and individuals guilty of unauthorized reproduction, distribution, and/or digital transmission of copyrighted material. In the music industry, record companies have broadened their surveillance to include individuals guilty of downloading large quantities of copyrighted files in addition to targeting file-sharing programs such as Napster and Kazaa. Indeed, 2003 saw an unprecedented string of lawsuits aimed to curb unauthorized use of copyrighted material: within a few months, the Recording Institute Association of America (RIAA) slapped several hundred individuals possessing sizeable digital music libraries with large fines.
